Terms and Conditions: High Ground Private Members Club

Welcome to High Ground (“the Club”, “we”, “us”). These Terms and Conditions (“Terms”) govern your membership and use of our private platform. By accessing our services, you acknowledge that you are entering into a private, non-commercial agreement within a closed user group.

1. Nature of the Club

High Ground is a Private Members Club and communal platform. We provide a secure venue for adult members to share information, legal accessories, and participate in private cultivation and sharing arrangements as permitted under South African law. The Club facilitates the private, non-commercial distribution of materials between verified members and does not engage in the public sale of cannabis.

2. Strict Age Requirement

Membership is strictly limited to natural persons 18 years of age or older. You must provide valid government-issued identification to verify your age before accessing any member-only sections of the Platform.

3. Private Membership Agreement

By registering, you formally apply to join the High Ground member community. You agree that:

  • All activities conducted through the Club are for your personal, private use only.
  • You will not sell, trade, or distribute any items obtained through the Club to non-members or the general public.
  • Any plants or products managed on your behalf remain your lawful private property throughout the process.

4. Description of Member Services

The Club provides a curated private environment offering:

  • Private Cultivation Support: Facilitation of legal home-grow and communal cultivation arrangements.
  • Smoking Accessories: High-quality grinders, vaporizers, and storage solutions.
  • Educational Resources: Guidance on South African cannabis laws, strain documentation, and cultivation techniques.
  • Community Forums: A private space for members to interact and share knowledge.

5. Provisioning and Distribution Policy

  • Handling: Orders are processed within 3-5 business days, and members will receive a tracking number via email.
  • Logistics: The Club utilizes a secure, centralized distribution model including a drop-off locker network and verified private couriers.
  • Limits: All distributions are subject to legal private possession limits as defined by the Republic of South Africa.

6. Export Restriction

Membership and provisioning are available to South African residents only. We do not ship or facilitate services outside the borders of the Republic of South Africa.

7. Contributions and Refunds

Membership contributions and fees are subject to availability.

  • Cancellation: Orders cancelled within 24 hours attract a 10% administration fee.
  • Returns: Damaged hardware may be returned within 7 days with photographic proof.
  • Hygiene: For health and safety, personal-use items cannot be returned once the seal is broken.

8. Membership Contributions & Service Levies

High Ground facilitates the non-commercial sharing of private materials between members. To maintain the platform and secure logistics network, the following structure applies:

  • Member Reimbursements: When requesting materials from a club grower, members provide a reimbursement for the actual costs of cultivation, including nutrients, power, and labor.
  • Horticultural Management Levy: High Ground applies a 15% Service Levy to all transactions. This fee covers platform security, age verification, compliance monitoring, and the coordination of the secure delivery network.
  • Non-Profit Principle: All contributions are used to sustain the private club’s operations and are not considered a commercial sale of cannabis.
  • Payment Options: We accept Credit/Debit Card payments (Visa and MasterCard) and Direct Bank Transfers (EFT).

9. Payment Security

To ensure member safety, all card transactions are acquired via an approved, secure payment gateway for South African banks.

  • Encryption: The gateway uses the strictest form of encryption, specifically Secure Socket Layer 3 (SSL3).
  • Data Protection: No credit card details are stored on the High Ground website.

10. Privacy and POPIA Compliance

The Club takes all reasonable steps to protect the personal information of members in accordance with the Protection of Personal Information Act (POPIA). Your data is used solely for age verification and membership management.

11. Prohibited Conduct

Members strictly agree not to:

  • Engage in commercial “dealing” or public trade of cannabis.
  • Misrepresent their age or identity.
  • Bring the Club into disrepute by violating the private-use spirit of the law.

12. Limitation of Liability

High Ground provides the platform and facilitation services. The Club is not liable for any damages arising from the use of products or participation in the private club, and members indemnify the Club against any legal consequences arising from their own misuse of provided materials.

13. Governing Law

This agreement is governed by the laws of the Republic of South Africa.
