1. The Role of High Ground Marketplace
High Ground provides a private, members-only venue for independent, third-party vendors (“Vendors”) to sell their legal smoking accessories and related gear to customers (“Customers”). High Ground is a facilitator and is not the seller of record for products sold by Vendors. All Vendors are carefully vetted to ensure quality and compliance.
2. Age Verification
You must be 18 years of age or older to access or use this Platform. By using this site, you confirm that you meet this age requirement.
3. User Accounts & Membership
To make a purchase or become a Vendor, you must register for an account and agree to our Membership Terms, thereby becoming a member of the High Ground member community. You are responsible for maintaining the confidentiality of your account information.
4. Detailed Description of Goods and Services
High Ground Marketplace operates in the smoking accessories and lifestyle products industry, providing a curated online marketplace that offers:
- Smoking accessories (grinders, rolling papers, storage containers, vaporizers)
- Lifestyle and wellness products for lifestyle enthusiasts
- Apparel and branded merchandise
- Educational materials and resources
All products are supplied by independent, verified Vendors who are responsible for product quality, descriptions, and compliance with applicable laws.
5. Delivery Policy
Subject to availability and receipt of payment, orders will be processed within 3-5 business days and delivery will be confirmed by way of tracking number and shipping notification email.
High Ground facilitates a centralized shipping model through a secure dropoff locker network. Shipping is handled via courier service at a flat rate. The shipping fee is collected from the Customer at checkout and covers the cost of courier services. Estimated delivery time is 5-7 business days from order confirmation, depending on location within South Africa.
Customers will receive:
- Order confirmation email immediately upon purchase
- Shipping confirmation with tracking number once order is dispatched
- Delivery notification when order reaches the designated pickup location
6. Export Restriction
The offering on this website is available to South African clients only. We do not ship internationally at this time.
7. Returns and Refunds Policy
The provision of goods and services by High Ground Marketplace is subject to availability. In cases where products are unavailable after purchase, High Ground Marketplace will refund the client in full within 30 days.
Cancellation Policy:
- Cancellation of orders by the customer within 24 hours of purchase will attract a 10% administration fee
- Orders cannot be cancelled once shipped
Returns Policy:
- Products damaged during shipping may be returned within 7 days of receipt
- Proof of damage (photographs) must be provided
- Refunds for damaged goods will be processed within 14 days of approved return
- Products must be unused and in original packaging for non-damage returns
- Hygiene products (mouthpieces, personal-use items) cannot be returned once opened unless defective
Guarantees and Warranties:
- Electronic products (vaporizers, etc.) carry manufacturer warranties as specified in product descriptions
- Vendor-specific warranty information is provided on each product page
- High Ground facilitates warranty claims but is not responsible for manufacturer warranty fulfillment
8. Payments, Commissions, and Fees
All payments are processed securely through our designated payment gateway. High Ground charges Vendors a 15% commission on the sale price of products. This fee covers platform use, marketing, and payment processing services. Vendors receive their earnings (sale price minus commission) and can request a payout according to the terms outlined on our “Become a Vendor” page.
9. Payment Options Accepted
Payment may be made via Visa, MasterCard, SID Secure EFT, Capitec Pay, Mobicred, Apple Pay, Samsung Pay or by bank transfer into the High Ground Marketplace bank account, the details of which will be provided on request.
10. Payment Security
Card transactions will be acquired for High Ground Marketplace via Payfast by Network who are the approved payment gateway for all South African Acquiring Banks.
Payfast by Network uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no card details are stored on the website.
Users may go to https://payfast.io/ to view their security certificate and security policy.
11. Customer Details Separate from Card Details
Customer details will be stored by High Ground Marketplace separately from card details which are entered by the client on Payfast by Network’s secure site. For more details on Payfast by Network refer to www.payfast.io.
12. Customer Privacy Policy
High Ground Marketplace shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “Personal Information” shall be defined as detailed in the Protection of Personal Information Act 4 of 2013 (POPIA).

13. Merchant Outlet Country and Transaction Currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
14. Responsibility
High Ground Marketplace takes responsibility for all aspects relating to the transaction including coordination of sales of goods and services sold on this website, customer service and support, dispute resolution, and facilitation of delivery of goods. While Vendors are the sellers of record for their products, High Ground manages the customer experience and platform operations.
15. Prohibited Conduct
Users of the Platform agree not to:
- Engage in any illegal activities
- Sell prohibited items (as determined by High Ground)
- Attempt to circumvent the platform’s commission structure by arranging private sales
- Misrepresent age or identity
- Use the platform for any unlawful purpose
16. Disclaimers and Limitation of Liability
High Ground does not manufacture, store, or inspect any of the products sold by Vendors. We provide the venue only. Products are sold for their intended legal purposes only.
High Ground will not be liable for any damages arising out of or in connection with your use of the Platform, including but not limited to product quality, safety, or fitness for purpose.
17. Country of Domicile
This website is governed by the laws of the Republic of South Africa and High Ground Marketplace chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature:

18. Variation
High Ground Marketplace may, in its sole discretion, change this agreement or any part thereof at any time without notice. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
